Terms of use
The terms this site is offered on.
These terms cover the use of memoire-marketing.com, the website of Mémoire, a brand-language studio placed in Lyon, France. By reading the site you accept them; they are written to be readable.
What the site is for
The site describes the work Mémoire does — naming, tone of voice and copy systems for small companies — and gives a way to send us a brief. It is information about a studio, offered so that you can decide whether to write to it. It is not a shop, a tool or a source of advice on your own company's language; that advice is what a project produces, under a written scope.
An enquiry is not a contract
Sending a brief through the form, or writing to the studio mailbox, is an enquiry. It does not engage the studio to do any work and does not oblige you to commission any. Work begins only when a written scope has been sent by us and agreed by you, and that scope — not this page — sets out what is made, in how many weeks, and on what terms. Until then either side can walk away without explanation, and we will say so plainly if we think the fit is wrong.
Nothing on the site is an offer capable of acceptance, and descriptions of how a project usually runs are descriptions, not promises about yours.
Using the site
You may read the site, link to it and quote short passages from it with the source named. You may not copy its pages wholesale, present its text as your own, use the form to send anything other than a genuine enquiry, attempt to interfere with the site or the relay service the form uses, or use automated means to scrape it beyond what a search engine reasonably does. Briefs that are abusive, unlawful or plainly not enquiries are deleted unanswered.
Intellectual property
The text of this site, the Mémoire name and mark, and the arrangement of the pages belong to the studio. The typefaces are used under their own licences. The photographs are the work of the people credited at the foot of this page and are used under the licences named there; they are not ours to relicense, and the credits tell you where each one came from.
Work produced under a scope is governed by that scope, which says who owns what. As a rule, once a project is paid for, the words we wrote for you are yours.
Accuracy and liability
We keep the site accurate and current, but it is offered as it stands. Descriptions of the work are general; the specifics of any project live in its scope. To the extent French law allows, the studio is not liable for loss arising from reliance on the site's general descriptions, from the site being unavailable, or from the actions of the third-party services — the form relay and the font host — that the site depends on. Nothing here limits liability that cannot lawfully be limited.
Privacy
How the site handles what you send it is described on the privacy page, which forms part of these terms.
Governing law
These terms, and any dispute arising from the use of the site, are governed by the laws of France. The courts of Lyon have jurisdiction, without prejudice to any right a consumer has to bring proceedings where they live.
Changes
We may revise these terms by publishing a new version on this page with a new date at the top. Continuing to use the site after that date is acceptance of the revised terms. We do not notify changes by email, because we hold no list to notify.
